Please read the following Terms and Conditions (“Terms”) carefully before using the TRAPPED Windsor services. Please note that by signing this document you will waive certain legal rights, including the right to sue.

ASSUMPTION OF RISK

​

I, the undersigned, wish to utilize certain entertainment services provided by 1000742738 Ontario Inc. (hereinafter called 1000742738 Ontario Inc.), operating as “TRAPPED Windsor” (hereinafter called the “Game”).

I recognize and understand that playing the Game involves certain risks. Those risks include, but are not limited to, the risk of injury or damage to personal property resulting from possible malfunction of the equipment and injuries or damage to personal property from tripping or falling over obstacles. In addition, I recognize that the exertion of playing the Game could result in injury or death.

Despite these and other risks, and fully understanding such risks, I wish to play the Game and hereby assume the risks of playing the Game. I hereby certify to 1000742738 Ontario Inc. that I am in good health and do not suffer from a heart condition or any other ailment which could be exacerbated by the exertion involved in playing the Game.

I further certify that I am 18 years of age or older.

RULES; RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY

In consideration of participating in the Game, I hereby agree as follows:

1. Not to use any electronic devices while participating in the Game;

2. Not to engage in photography or videography while participating in the Game;

3. Not to create records of my participation in the Game in any fashion, including, but not limited to, written recording of any element of the Game;

4. Not to engage in any violent or disorderly conduct while on the 1000742738 Ontario Inc. premises (hereinafter called the “Premises”);

5. Not to damage any property while on the Premises;

6. Not to remove any items from the Premises;

7. To compensate 1000742738 Ontario Inc. up to $200.00 if I am in violation of this Agreement and that such remedy is in addition to and not in lieu of any other remedies which may be available to 1000742738 Ontario Inc.;

8. To indemnify 1000742738 Ontario Inc. for any and all damage done to its property;

9. To waive any and all claims that I have or may in the future have against 1000742738 Ontario Inc., their directors, officers, employees, agents and representatives (all of whom are collectively referred to as the “Releasees”) and to release the Releasees from any and all liability for any loss, damage, injury or expense that I may suffer or that my next of kin may suffer, as a result of my participation in the Game due to any cause whatsoever;

10. To hold harmless and indemnify the Releasees from any and all liability for any damage to property of, or personal injury to, any third party, resulting from my participation in the Game;

11. That this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators and assigns.

I HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST 1000742738 Ontario Inc.

CLARIFICATION, DETAILS AND EXAMPLES ​

THE ABOVE ACTS AS AN ACCIDENT WAIVER AND RELEASE OF LIABILITY 
BY ACCEPTING TO ENTER THE PREMISES AND MAKE A BOOKING AT OUR FACILITY YOU HEREBY ACCEPT THE GENERAL TERMS AND CONDITIONS OF THE BUSINESS AS WELL AS ITS WAIVER OF RIGHTS.

THIS MEANS YOU ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THE GAMES, ACTIVITIES AND EVENTS, ORGANIZED AT and AROUND THE FACILITIES OF 1000742738 Ontario Inc.. O/A: TRAPPED WINDSOR.

" including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

You agreed to the below:
I/We certify that I understand this activity has potential risks including but not limited to:
1) Use of simple tools, game objects and other items;
2) Potentially moving or lifting objects of not more than 12 Kilograms;
3) Possible Mental stress, fear, anxiety, epilepsy and brain damage;
4) Being in a reasonably small space with or without other people;
5) Possibility of failure to escape the room in the allotted time;

6) Possibility of game malfunction, breakage, or incorrect reset;
7) Possibility of falling objects;

8) Possibility of tripping, falling, bumping into objects or other players.

I (WE), the undersigned, on behalf of myself and the participants and the legal guardians of underage participants, wish to utilize the entertainment services provided by Trapped Windsor, called the “Game” or 'Games" or "Escape Room/s", or "The Activities").

I/We recognize and understand that playing the Game and utilizing the facility at Trapped WINDSOR may involves certain risks. Those risks include, but are not limited to, the risk of physical or psychological injury, the risk of trauma, the risk of loss or damage to personal property resulting from possible malfunction of the equipment, roughness of props and decor and injuries or damage to personal property from tripping or falling over obstacles. In addition,

I/We recognize that the exertion of playing the Game could result in injury or even death.

Despite these and other risks, and fully understanding such risks, I/we wish to play the Game/Games and engage in other activities offered by TRAPPED WINDSOR and its owners, affiliates, associates, contractors,  and employees.

I/We hereby assume all the risks of playing the Game/GAMES.

I/We certify to Trapped Windsor that I am and the minors in my care that are participating in the game are in good health and do not suffer from heart conditions or any other physical or mental, psychological ailment or condition which could be exacerbated by the exertion involved in playing the Game/Games or participating in the activities or using the facilities at and around TRAPPED WINDSOR LOCATION.

I/We hereby certify that I/We have informed all players/participants in my group and/or their parents or legal guardians (if participants are under the age of 18) of the risks mentioned herein this waiver. That I informed them to obey the rules and refrain from participating in horssplay, forceful, violent, disrespectful or illegal  acts.

I am providing true information about myself and my group and signing my true signature. Any misrepresentation of the information provided herein will automatically deem any court claim or complaints null and void.

I/We hereby acknowledge that all of the game room and other common areas are under security surveillance, and I agree to be video recorded for safety and security reasons.

I/We agree that Trapped WINDSOR  may take my/our video or photo to publish on Trapped social media and I understand I could opt out if I do not wish for my picture to be used in marketing material.

I/We have no physical or mental illness that precludes my participation in a safe manner for myself or others. I am not under the influence of drugs or alcohol which impairs my ability to maintain my safety awareness or endangers others. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the activity in which I may participate, and that it will govern my actions and responsibilities at said activity. I agree that all staff or authorized agents may, in their sole discretion, determine it is unsafe for myself or others for my participation to continue, remove me from the premises by any lawful means. In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising
from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property
damage, property theft, or actions of any kind which may hereafter occur to me, THE FOLLOWING ENTITIES OR
PERSONS: The directors, officers, employees, volunteers, representatives, and agents of any and all entities
authorizing this activity;
(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this
paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by
the negligence of release or otherwise.
I acknowledge that the directors, officers, employees, volunteers, representatives, and agents of any authorizing entity are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. The undersigned further acknowledges that he/she has inspected the facilities, equipment, and areas to be used for the TRAPPED WINDSOR venue and is voluntarily participating despite the risk of falls, contact and/or crashes with other participants, defective equipment, the condition of the room and any hazards that may be posed by spectators or volunteers.

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.
I agree that TRAPPED WINDSOR or any of its agents has the right to any photos or any video/sound footage of me during the event. These photos, video footage and sound materials may be used for any marketing purposes. However, I understand I have the right to opt out of this in writing to inform TRAPPED WINDSOR to refrain from publishing any image of me where i can be easily identifiable. 

I fully understand that there are no refunds under any conditions once I purchase my entrance fee.

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE
THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ELECTRONICALLY OF MY OWN FREE WILL.
WHEN REGISTERING ONLINE, MY ONLINE SIGNATURE SHALL SUBSTITUTE FOR AND HAVE THE SAME
LEGAL EFFECT AS IF I HAD SIGNED A WAIVER AND RELEASE AGREEMENT.

BY BOOKING AND ENTERING THE FACILITY YOU ARE DEEMED TO AUTOMATICALLY IN AGREEMENT ACCEPTANCE OF THE ABOVE TERMS EVEN IN THE EVEN OF LOSS OR DESTRUCTIO OF THE SIGNED FORM.
